Welcome to Oodle! These Terms of Service ("Terms") form a legal agreement between you ("you," "your," or "User") and Oodle ("Oodle," "we," "us," or "our") regarding your access to and use of the Oodle mobile application, website, and related services (collectively, the "Services"). By accessing or using our Services, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

1. Age Restrictions and Eligibility

  • You must be at least 13 years old to use Oodle. If you are an EU resident, you must be 16 years old or older.
  • By using Oodle, you confirm that you meet the age requirement. If you are under the required age, you are strictly prohibited from using the Services.

Important: If you falsify your age to access Oodle, you do so at your own risk. Oodle is not responsible for any consequences resulting from such misuse.

If you are under 13 years old OR if you are an EU citizen or resident under 16 years old, do not sign up for the Services – you are not authorized to use them.

2. User Responsibilities and Conduct

By using Oodle, you agree to the following conditions:

  • Accurate Information: You must provide accurate and truthful information when creating an account.
  • Account Security: You are responsible for maintaining the confidentiality of your password and account. You agree to immediately notify Oodle of any unauthorized use of your password or account or any other breach of security. Oodle will not be liable for any loss or damage arising from your failure to comply with this obligation.
  • Respectful Behavior: You must not engage in offensive, abusive, harassing, or unlawful behavior, including hate speech, harassment, threats, or discrimination.

Prohibited Content

You must not submit any content that:

  • Infringes intellectual property rights.
  • Contains viruses, malware, or harmful code.
  • Promotes self-harm, violence, or illegal activity.
  • Facilitates or promotes harassment, threats, or exploitation of any individual.
  • Violates privacy, security, or personal rights of others.

User Conduct

You must not:

  • Violate any applicable laws or regulations.
  • Impersonate any person or entity.
  • Harvest or collect personal information of other users.
  • Reverse-engineer, disassemble, or attempt to access the app's source code.

Oodle reserves the right to investigate, suspend, or terminate accounts found in violation of these terms.

3. AI-Powered Chat Feature (Google Gemini)

Oodle uses Google Gemini, an external AI service, to power certain chat features within the app. By choosing to interact with AI profiles, you acknowledge and agree to the following:

  • No Professional Advice: Responses generated by the AI are for entertainment and general informational purposes only. They do not constitute medical, psychological, legal, financial, or any other form of professional advice.
  • External Service Disclaimer: The AI chat functionality is powered by Google Gemini, an external third-party service. Oodle does not develop, control, or influence the outputs of the AI. As such, we are not responsible for any statements, implications, or actions resulting from AI-generated content.
  • Use at Your Own Risk: You engage with AI features entirely at your own risk. Oodle expressly disclaims any liability arising from your use of or reliance on AI-generated content, including—but not limited to—emotional distress, misinformation, offensive language, or inappropriate responses.
  • No Liability: If you have concerns, complaints, or adverse experiences related to AI-generated interactions, you acknowledge that these are not the responsibility of Oodle. The technology is provided "as-is," and any recourse or claims must be directed to the AI provider, Google.
  • AI Limitations: While moderation and safety filters are built into Google Gemini, no system is perfect. Users are expected to exercise discretion and report any concerns using Oodle's in-app tools or support email.

4. Content Storage and Data Retention

  • User Data: Oodle stores user-generated data, including chat history, on Google Firebase servers. This data is retained as long as the user account remains active.
  • Account Deactivation: When you delete your account, all associated data will be permanently deleted within 30 days, unless required by law.
  • No External Sharing: Oodle does not sell, rent, or share user data with third parties. However, we use tools like Google Analytics and Firebase for internal app performance monitoring.

5. User Reporting and Moderation

If you encounter inappropriate behavior, offensive content, or suspicious activity, you can:

  • Report In-App: Use the in-app reporting feature to flag the content.
  • Email Support: Send a detailed report to hello@oodle.social.

Oodle reviews reports promptly and reserves the right to immediately ban users for serious offenses. We are not responsible for incidents we are unaware of unless reported.

6. Premium Features and Refund Policy

Oodle offers optional premium features with in-app purchases. By subscribing, you agree to the following:

  • No Refunds: All premium purchases are non-refundable, including partially used subscriptions.
  • Billing: Subscriptions auto-renew unless canceled before the renewal date.

7. Liability Disclaimer and Waiver

Oodle provides its Services on an "as-is" and "as-available" basis. To the fullest extent permitted by law:

  • No Guarantees: Oodle does not guarantee uninterrupted service, accurate content, or error-free AI-generated responses.
  • User Liability: You use Oodle at your own risk. Oodle is not liable for emotional distress, harm, or damages resulting from user interactions or AI-generated content.
  • Third-Party Responsibility: Google Gemini provides the AI system used in Oodle. Any concerns regarding AI-generated responses should be directed to Google, not Oodle.

Mental Health and Safety: If you are experiencing emotional distress, self-harm thoughts, or mental health issues, please seek professional help immediately. Oodle and its AI features are not substitutes for professional support.

In the unfortunate event of self-harm, injury, or loss associated with AI use, Oodle disclaims all liability. Users agree that Oodle cannot be held responsible under any circumstances.

8. Account Termination and Inactivity

  • Oodle reserves the right to suspend or terminate accounts that violate these Terms.
  • Inactive accounts will remain active until the user deletes them. Upon deletion, all associated data will be removed within 30 days.

9. Intellectual Property

  • User Content: Users retain rights to their content but grant Oodle a non-exclusive, worldwide, royalty-free license to display and share content within the app.
  • App Content: Oodle, its logo, features, and functionalities are protected by copyright and intellectual property laws.

10. Dispute Resolution and Governing Law

  • Binding Arbitration: All disputes must be resolved through binding individual arbitration, not class action.
  • Jurisdiction: These Terms are governed by the laws of India, and disputes will be resolved in courts located in Mumbai, Maharashtra.
